On March 4, 2024, the State of Colorado adopts House Bill 24-1356, which proposes revisions to the "Colorado Consumer Protection Act" to classify the sale of electronic smoking devices without FDA permission as unfair or misleading commercial practices. The bill requires manufacturers to get FDA authorization before they can legally sell such devices in the state. It also requires the Attorney General to create and maintain a directory including information on manufacturers and FDA-approved electronic smoking devices. Retailers, distributors, wholesalers, and intermediates are not permitted to sell electronic smoking devices without FDA approval and participation in the directory. Violations of the bill may result in civil penalties under the "Colorado Consumer Protection Act".
