The Maine State Law has been amended to prevent Perfluoroalkyl and Polyfluoroalkyl Substances Pollution (PFAS) pollution. The amendment was approved on April 16, 2024, by Governor Chapter 630. The law defines "alternative" as a substance or chemical that can reduce potential harm to human health or the environment if used in place of PFAS. The Department of Health and Human Services (DHS) has issued a new regulation requiring manufacturers to notify the DHS of intentionally added PFAS in their products. Manufacturers must provide a brief description of the product, the purpose of PFAS use, the amount of each PFAS, the manufacturer's name and address, and any additional information required by the DHS. Manufacturers must pay the applicable fee and update the information as needed. Starting January 1, 2025, 2032, a person cannot sell, offer, or distribute a product containing PFAS if the manufacturer fails to provide necessary information.
