On 10 June 2026, World Trade Organization (WTO) circulated a notification submitted by the United States of America regarding a proposed rule issued by the U.S. Environmental Protection Agency (EPA) under the Toxic Substances Control Act (TSCA). The notification covers chemical substances, including products within the chemical industry and environmental protection sectors (ICS 13.020, 71.020, and 71.100). The notified document, titled "Significant New Use Rules on Certain Chemical Substances (26-1)," proposes Significant New Use Rules (SNURs) for certain chemical substances that were previously subject to Premanufacture Notices (PMNs) and EPA orders. Under the proposal, manufacturers (including importers) and processors intending to undertake designated significant new uses must notify the EPA at least 90 days before commencing such activities. The notification will enable the EPA to evaluate the intended use and determine whether additional regulatory action is necessary before manufacture or processing may proceed. The proposed rule aims to protect human health and safety and the environment by ensuring oversight of new uses of regulated chemical substances. The proposed dates of adoption and entry into force are yet to be determined. Comments will be accepted until 10 July 2026, allowing WTO Members and stakeholders to submit observations through the U.S. TBT Enquiry Point for consideration by the EPA.
