On 12 December 2025, the Official Journal of the European Union published Directive (EU) 2025/2456, amending the RoHS Directive (Directive 2011/65/EU). The amendment transfers several scientific and technical responsibilities to the European Chemicals Agency (ECHA) to support the EU’s “one substance, one assessment” approach. Under Annex II, ECHA is formally tasked with preparing dossiers for substance restrictions, either at the request of the European Commission or in cooperation with Member States. The list of restricted substances must now be reviewed at least every four years. These changes will apply from 13 August 2027. Under Annex V, exemption procedures are revised by shifting the submission of exemption applications from the European Commission to ECHA. A structured process is introduced, including a 45-day completeness check, defined timelines for RAC and SEAC opinions, and a nine-month decision period for the European Commission. Renewal applications must be filed at least 18 months before expiry, with existing exemptions remaining valid until a decision is made. These provisions take effect from 27 August 2027. Overall, the revision aims to harmonize chemical risk assessments, improve transparency and efficiency, reduce administrative burdens, and strengthen regulatory consistency across EU chemicals legislation.
