The European Commission proposed a targeted amendment to Regulation (EU) No 528/2012 (Biocidal Products Regulation, BPR) as part of the Food and Feed Safety Simplification Omnibus Package, announced in the Vision for Agriculture and Food. The proposal addresses stakeholder concerns over the impending expiry of data protection on 31 December 2025 under Article 95(5) for existing biocidal active substances still in the delayed review programme. Delays stem from resource shortages in Member States, poor initial application quality, complex dossiers, evolving guidance, and new endocrine disruptor criteria (applicable since 7 June 2018 via Delegated Regulation (EU) 2017/2100). To balance interests of review programme participants (data owners) and alternative suppliers/product authorisers, the amendment extends protection for all data related to active substance/product-type combinations without approval decisions by 7 June 2018 until 31 December 2030 (aligning with the review programme's extension). This covers newly generated data (e.g., for endocrine properties or updated requirements), providing up to 11.5 years of protection while maintaining fair market access post-2030. Data owners may claim compensation for access during any interim unprotected period (from 1 January 2026 until entry into force). Article 60(1) is derogated to allow re-protection of such data. The measure ensures legal certainty, incentivises data generation, and supports innovation/competitiveness without undermining health/environmental protections.A full BPR evaluation is planned for 2026/2027. The proposal, separate for swift adoption, awaits Parliament/Council review.
