On December 8th, 2025, the World Trade Organisation (WTO) has circulated a notification titled European Union Notifies WTO of Draft Commission Implementing Decision Not Approving Formaldehyde for Use in Certain Biocidal Products. The draft measure concerns biocidal products and proposes not to approve formaldehyde released from the reaction products of paraformaldehyde and 2-hydroxypropylamine (ratio 1:1) as an existing active substance for use in biocidal product-type 6, in accordance with Regulation (EU) No 528/2012 on biocidal products. The draft decision concludes that the substance meets the exclusion criteria under Article 5(1) of Regulation (EU) No 528/2012 and does not satisfy any of the conditions for derogation set out in Article 5(2). Furthermore, the substance fails to meet the approval conditions under Article 4(1) of the Regulation. As a result, its use as an active substance in biocidal products of the specified product type would not be permitted within the European Union. The objective of the proposed decision is the protection of human health and safety, the protection of the environment, and the harmonization of biocidal product regulation across the EU. The decision is planned for adoption in March 2026, with entry into force 20 days after publication in the Official Journal and application 12 months after adoption.
