"South Africa has notified the World Trade Organization (WTO) of draft regulations establishing new controls over the sale of frozen fruit and frozen vegetables in the country. Issued under the Agricultural Product Standards Act, 1990, the proposed rules introduce mandatory grading standards, strict labelling requirements, packing and container specifications, and temperature-controlled storage and transport conditions for all frozen fruit and vegetable products sold within the Republic.
Under the draft regulation, no frozen fruit or vegetable product may be sold unless it meets multiple conditions. Products must be graded according to three categories — Choice Grade, Standard Grade, and Substandard Grade — and must comply with detailed quality standards relating to freshness, colour, flavour, and absence of pests or extraneous substances. Vegetables must show negative results for peroxidase and catalase enzyme activity to confirm proper processing. Only additives and foodstuffs permitted under the Foodstuffs, Cosmetics and Disinfectants Act, 1972 may be included.
The regulation also requires products to be packed, marked, and displayed according to prescribed rules. Containers must comply with defined specifications, and prohibited or misleading claims are not allowed. All products must follow strict temperature requirements during storage and transport to protect product integrity. The Executive Officer may issue conditional exemptions, taking into account consumer fairness, safety implications, and other relevant factors.
The WTO notification explains that the amendment aims to establish minimum quality standards, enhance consumer information, and harmonize the labelling of frozen produce offered for sale in South Africa. The proposal does not address food safety matters. Products covered include frozen fruits and vegetables, whether preserved or pre-cooked.
Stakeholders are invited to submit comments until 5 January 2026, with the South African Bureau of Standards (SABS) designated as the contact point for enquiries. The dates of adoption and entry into force will be announced later."
