"The Food and Drug Administration (FDA) of Thailand has issued a draft announcement on Food Advertising Criteria to ensure consumer protection aligns with the evolving media landscape and contemporary consumer behavior. The draft aims to provide clear guidance on the regulation of food advertisements and marketing practices in Thailand, helping both consumers and businesses understand acceptable standards. The key points are as follows:

1. Repeal the Food and Drug Administration’s Announcement on Food Advertising Criteria, B.E. 2564 (2021), dated March 25, B.E. 2564 (2021), and use this draft announcement.

2. Adjust the specific criteria for food advertising to align with the current announcement from the Ministry of Public Health and incorporate specific criteria for advertising certain types of foods. For example:

- Incorporate specific criteria for advertising dietary supplements containing kratom.

- Incorporate specific criteria for the advertising of foods containing hemp seeds, hemp seed oil, or hemp seed protein; foods containing cannabis or hemp; and foods containing cannabidiol extract.

3. Modify List 1, ""Terms Prohibited in Advertising the Quality, Benefits, or Properties of Foods,"" and ""Terms Prohibited in Food Advertising."" This includes adding definitions of the prohibited terms for greater clarity and reviewing the terms and phrases prohibited in advertising.

4. Review Account No. 2, which describes advertising features that are not necessary for approval."
