"The European Commission makes draft Commission Delegated Regulation proposes an amendment to Regulation (EU) 2019/1021 to include chlorpyrifos in Annex I as a persistent organic pollutant (POP), following Decision SC-12/9 adopted under the Stockholm Convention. The initiative aims to strengthen protection of human health and the environment by prohibiting the manufacture, placing on the market, and use of chlorpyrifos across the European Union.
- The proposal is published for public feedback and was opened for consultation from 21 November 2025 to 19 December 2025 (midnight Brussels time). During this four-week feedback period, stakeholders, including industry, civil society, and national experts, are invited to submit comments, which will be considered before finalisation. The Commission’s adoption of the final measure is planned for the first quarter of 2026.
- The legal basis for the draft regulation is Article 15(1) of Regulation (EU) 2019/1021, ensuring alignment with the EU’s international obligations under the Stockholm Convention and the Protocol on Persistent Organic Pollutants. The amendment reflects the decision taken at the twelth Conference of the Parties held in Geneva from 28 April to 9 May 2025.
- Unlike other substances, chlorpyrifos is proposed for listing without specific exemptions, as it is not approved in the EU for use in plant protection products or biocidal products. To support enforcement and prevent intentional use, the draft regulation establishes a very low threshold for unintentional trace contamination, setting a limit of 0.01 mg/kg (0.000001% by weight) in substances, mixtures, and articles. The regulation will enter into force 20 days after publication in the Official Journal of the European Union and will be directly applicable in all Member States."
