The New Mexico Environment Department’s Office of Strategic Initiatives (OSI) has petitioned the Environmental Improvement Board (EIB) to adopt a new rule, 20.13.2 NMAC, regulating per- and polyfluoroalkyl substances (PFAS) in consumer products. The petition requests consideration at the Board’s October 24, 2025, meeting and a hearing order by November 5, 2025, with the hearing to occur before March 13, 2026. The rulemaking aligns with the PFAS Protection Act, enacted on April 8, 2025, which mandates the Board to adopt rules for PFAS reporting, exemptions, labeling, and identification of unavoidable essential uses. OSI recommends appointing an administrative hearing officer due to the rule’s complexity. The initiative aims to enhance consumer product safety and environmental protection through structured PFAS regulation under the Environmental Improvement Act.
