On December 9th, 2025, the World Trade Organisation (WTO) has circulated a notification titled “The State of Kuwait Notifies WTO of Technical Regulation for Biodegradable Plastic Bags.” The proposed technical regulation applies to sacks and bags and establishes a comprehensive regulatory framework for biodegradable plastic bags placed on the Kuwaiti market. The draft regulation sets out terms and definitions, scope and objectives, as well as supplier obligations, labelling requirements, and conformity assessment procedures. It also defines the roles and responsibilities of regulatory authorities, including market surveillance powers, and outlines violations, penalties, general provisions, and transitional arrangements. Detailed appendices specify applicable lists and types of biodegradable plastic bags covered under the regulation. The objective of the proposed regulation is the protection of the environment, by promoting the use of biodegradable alternatives and strengthening regulatory oversight of plastic bag products to reduce environmental impact. The regulation is intended to support environmental sustainability while ensuring compliance through clear enforcement and conformity mechanisms. The proposed date of adoption has not yet been determined, and the regulation is expected to enter into force six months after adoption. Final date for comments: 7 February 2026.
