On April 27, 2026, the World Trade Organization (WTO) circulated notification G/TBT/N/USA/2273 submitted by the United States, introducing proposed Significant New Use Rules (SNURs) under the Toxic Substances Control Act (TSCA). The measure is issued by the U.S. Environmental Protection Agency (EPA). The proposed rule applies to certain chemical substances that were previously subject to premanufacture notices (PMNs) and EPA orders. It requires manufacturers and processors to notify the EPA at least 90 days before beginning manufacture, import, or processing of these substances for any activity designated as a "significant new use." This notification allows EPA to assess the intended use and determine whether additional regulatory controls are necessary before such activities may proceed. The objective of the measure is to strengthen environmental protection by ensuring that new or modified uses of listed chemical substances are reviewed for potential risks prior to commercialization. The rule also supports improved regulatory oversight under TSCA to prevent unintended environmental and health impacts. The draft regulation is currently open for public consultation, with comments accepted until May 26, 2026. The proposed date of adoption and entry into force are yet to be determined.
