On 6 May 2026, World Trade Organization (WTO) circulated a communication submitted by the United States of America regarding the extension of postponement of effectiveness for certain provisions of the final rule titled “Trichloroethylene (TCE); Regulation Under the Toxic Substances Control Act (TSCA).” The communication was circulated at the request of the United States delegation and relates to the previously notified measure under G/TBT/N/USA/2062/Add.1. The United States Environmental Protection Agency (EPA) was identified as the responsible agency for the measure. The communication concerns regulatory provisions applicable to trichloroethylene (TCE) under Title 40 of the Code of Federal Regulations (CFR) Part 751. According to the notification, EPA is extending the postponement of effectiveness for specific conditions imposed on uses covered by exemptions under Section 6(g) of the Toxic Substances Control Act (TSCA). The postponement applies to conditions associated with the final rule originally published on 17 December 2024 in the Federal Register (89 FR 102568). EPA stated that, effective 18 May 2026, the conditions imposed on the TSCA Section 6(g) exempted uses of TCE will remain postponed until the conclusion of ongoing judicial review proceedings. The extension was published in the Federal Register on 5 May 2026 under 91 FR 24133.
