"Decree No. 12,688, published on October 21, 2025, regulates Articles 32 and 33 of Brazil’s National Solid Waste Policy (Law No. 12,305/2010). It formally establishes the reverse logistics system for plastic packaging, assigning shared responsibility to manufacturers, importers, distributors, and retailers for the collection, reuse, and recycling of plastic packaging across its entire lifecycle.

The decree defines operation models (individual and collective), requires annual reporting through SINIR, and prioritizes the involvement of waste picker cooperatives. It sets recovery and recycled content targets, mandates the inclusion of post-consumer recycled (PCR) resin, and enforces compliance through traceable invoices and audits.

Manufacturers and importers must ensure environmental education campaigns, maintain return points, and meet gradual recycled-content obligations starting January 2026 for large companies and July 2026 for small and medium enterprises. The decree also details consumer responsibilities, integration with municipal waste systems, and establishes sanctions for non-compliance."
