AB-823, introduced by Assembly Member Boerner and coauthored by Senator Gonzalez, amends Sections 42361 and 42362 of the California Public Resources Code to regulate plastic microbeads and plastic glitter in personal care and cleaning products. Under the existing Plastic Microbeads Nuisance Prevention Law, products containing plastic microbeads used for exfoliation or cleansing in rinse-off products, such as toothpaste, are prohibited, with an exemption for concentrations below one part per million (ppm). Violations may incur civil penalties up to $2,500 per day. The 2025 amendment extends the prohibition: starting January 1, 2029, products containing plastic glitter or non-rinse-off products and cleaning products with one ppm or more plastic microbeads as abrasives cannot be sold, distributed, or promoted in California. Until January 1, 2030, existing stocks of products containing plastic glitter may continue to be sold. The law empowers the Attorney General and local authorities to enforce compliance.
