"The California Department of Justice issued an information bulletin on 10 November 2025 detailing upcoming enforcement actions related to the state’s flavored tobacco ban and the scheduled launch of the Unflavored Tobacco List (UTL). Under Assembly Bill 3218, the Attorney General was required to publish the UTL by 31 December 2025 to identify tobacco products without characterizing flavors that could legally be sold in the state. The DOJ stated that its enforcement priorities would continue to target “obviously flavored” products—those containing non-tobacco flavors in their trade names or previously identified in Attorney General guidance. The bulletin reaffirmed that flavored products remained prohibited under California Health and Safety Code section 104559.5.

For products not included on the initial UTL and not considered obviously flavored, the DOJ indicated it would first focus on educating manufacturers about statutory requirements and the registration process rather than taking immediate enforcement action. However, it warned that unregistered products remained subject to seizure and penalties. The bulletin also noted that further guidance, including rules for mixed multi-packs, would be incorporated into forthcoming UTL regulations expected by August 2026. Enforcement actions would continue to target wholesalers selling illegal flavored products and unlicensed or online sellers distributing prohibited tobacco items."
