"The U.S. Food and Drug Administration (FDA) has put forward a proposed regulatory order to revoke the existing allowance for using the synthetic dye Orange B on the casings or surfaces of frankfurters and sausages.


Here are the key points:
Orange B is currently listed under 21 CFR § 74.250 for that specific use (i.e., color additive regulation)

The FDA’s records show that no new batch certifications have been requested for Orange B since 1978

Because of the lack of use or demand, the FDA tentatively concludes that the authorized use has been abandoned by industry, and so the regulation is now outdated and unnecessary

If finalized, the order would remove § 74.250, meaning any existing certificates for Orange B would cease to be effective, and any future use would render the food adulterated under U.S. law


The FDA is accepting public comments until October 17, 2025
