"Introduction of Approval Requirement for Recycled Materials: A new legal provision is proposed to require that imported food utensils, containers, and packaging made from recycled materials must be approved by the MFDS for compliance with the standards set under Article 9-2 of the Food Sanitation Act. Definition of Recycled Materials: Recycled materials are defined as raw materials obtained by reprocessing used food utensils, containers, and packaging for reuse. Application and Approval Process: Importers must submit designated documents to the MFDS to obtain approval for the use of recycled materials. The MFDS may request additional safety verification data when necessary. Issuance and Cancellation of Approval: If the recycled materials meet the required safety standards, MFDS will issue an official approval certificate. However, any approval obtained through false or fraudulent means will be subject to immediate cancellation. Import Ban Without Approval: It will be prohibited to import or sell food utensils, containers, and packaging made from recycled materials without the required MFDS approval. Penalties for Violations: Violating this requirement (importing or selling non-approved products) may result in a prison sentence of up to 5 years or a fine of up to KRW 50 million, or both.
