"The U.S. Environmental Protection Agency (EPA) announced it will begin prioritizing reviews of new chemicals under the Toxic Substances Control Act (TSCA) that are intended for use in data center projects or in manufacturing components covered by Executive Order 14318, Accelerating Federal Permitting of Data Center Infrastructure. Starting September 29, 2025, submissions flagged for such uses will receive expedited review to support the rapid development of data centers and related infrastructure essential for artificial intelligence (AI) growth. EPA Administrator emphasized that this initiative addresses the backlog of chemical reviews while advancing President Trump’s goal of making the U.S. the global AI capital. The prioritization aligns with Section 7 of the Executive Order, which directs expedited permitting of qualifying projects, including data centers and supporting transmission infrastructure. Companies can request prioritized review by submitting a cover letter through the Central Data Exchange (CDX), identifying the intended use and project details. This policy is part of EPA’s contribution to the administration’s broader Powering the Great American Comeback initiative, which links streamlined regulatory processes with economic growth, energy security, and America’s global leadership in AI innovation."
