On May 4, 2026, Peru notified the WTO of a proposed regulation to implement Law No. 32159 on the control of tobacco, nicotine, and substitute products for the protection of life and health. The draft regulation establishes measures governing the advertising, commercialization, consumption, monitoring, and enforcement of tobacco products, nicotine products, electronic cigarettes, and tobacco substitutes. The proposed regulation applies to a broad range of products, including combustible tobacco products, electronic cigarettes, vaping devices, nicotine-containing products, and tobacco substitutes intended for inhalation or human absorption. It also introduces provisions related to consumer information, labeling, public health protection, and education on the health, social, environmental, and economic impacts associated with the use of these products. The measure aims to strengthen Peru’s tobacco and nicotine control framework in line with the WHO Framework Convention on Tobacco Control and national public health objectives. The proposal was notified under WTO document G/TBT/N/PER/177, with comments accepted until July 3, 2026. The adoption date has not yet been determined, and the regulation is proposed to enter into force six months after publication in the Official Gazette El Peruano.
