On January 29, 2025, WTO circulated a notification regarding the USA's Safer Products Restrictions and Reporting Rule (Chapter 173-337 WAC), which was adopted in 2023 to implement the Safer Products for Washington program. This rule applies to priority consumer products manufactured, distributed, sold, or offered for sale in or into the state of Washington that contain a priority chemical. Starting January 1, 2025, manufacturers must comply with restrictions on certain consumer products containing specific priority chemicals. For other consumer products with intentionally added priority chemicals, manufacturers must report this information to the Washington State Department of Ecology by January 31, 2025.
Key compliance deadlines are:
1. Restrictions on priority chemicals took effect on January 1, 2025. No reporting is required if restrictions apply.
2. Manufacturers, distributors, and retailers must submit their first notification via HPCDS by January 31, 2025.
3. Products tracked from January 1, 2024, must be reported by January 31, 2025, and annually thereafter.
