On June 17, 2025, the World Trade Organisation (WTO) circulated a Draft Decree from Vietnam on the Management of Cosmetics. This draft Decree on the Management of Cosmetics in Vietnam consists of 10 chapters and 69 articles detailing the legal framework for cosmetic regulation. It begins with general provisions, including scope, definitions, and safety requirements. Cosmetics are classified based on composition, use, and application route. Notification is mandatory prior to production or market circulation—handled by the Ministry of Health for imports and provincial committees for domestic products. Manufacturing regulations include CGMP-Asia Pacific compliance and certificate requirements. The decree outlines import/export conditions, including the need for a Free Sale Certificate (CFS). It mandates a Product Information File (PIF), restricts certain advertising claims, and specifies labelling rules. Quality control sampling, product recalls, and destruction procedures are detailed. Responsibilities of stakeholders and enforcement mechanisms, including transitional provisions, are also included, ensuring harmonization with Asia Pacific standards. Comments are due by August 16, 2025 with proposed date of adoption in September 2025 and will be effective from July 01, 2026.
