On April 10, 2026, Ukraine circulated WTO TBT Notification G/TBT/N/UKR/379 to the Committee on Technical Barriers to Trade, notifying a draft Resolution of the Cabinet of Ministers titled "On Approval of the Procedure for the State Registration of Chemical Substances." The measure is issued by the Ministry of Economy, Environment and Agriculture of Ukraine and is notified under Articles 2.9.2 and 5.6.2 of the WTO TBT Agreement. The draft Resolution establishes a mandatory state registration system for chemical substances manufactured, imported, or placed on the Ukrainian market, including substances contained in chemical products. It sets a threshold of 1 tonne per year for registration requirements and defines methodologies for calculating substance quantities. The procedure also outlines exemptions, including substances already registered by upstream suppliers, active substances in plant protection products and biocides, and certain substances governed by existing technical regulations on chemical safety. The draft further specifies application procedures, documentation requirements, electronic and paper submission options, registration timelines, refusal conditions, and the establishment of a national State Register of Chemical Substances. It allows registration decisions to be of unlimited duration and includes provisions for authorized representatives to act on behalf of foreign applicants. The objective of the measure is the protection of human health and the environment, as well as regulatory harmonization with international chemical safety frameworks. A 60-day comment period is provided, with the final deadline for comments set as June 9, 2026.
